this case is in Tennessee, I was living in New York at the time I was taking out the loan, if that matters. I've been living in Tennessee for over 10 years.
Got a letter in the mail from capital management services, LP representing the discover student loans. The last time I made a payment to this account was over 8 years ago and I haven't made any other payments or promises of payments since. I don't want to discuss the ethics of my non-payment. I know that the sun has passed, and they talk about it in their letter, which is amazing. They haven't tried to call me yet.
My question is: Should I completely ignore this?
Should I send them anything challenging the legitimacy of this debt? Warn them not to write on my credit report? Just send them a cease and desist letter?
Or should I just write it down and not answer their calls and never contact them?
I'm not sure the laws surrounding them can put this on my credit report. I would think they can't, but I'm not sure. That's why I'm writing here. I also don't want to inadvertently drop the salt.
I will attach the email they sent to this post as a photo with the identification bits marked. Thanks everyone. Happy New Year to you!
I have the debt collector company call me all the time. I hate it, they tricked me with the contract...
This is a very unpleasant situation, and I know it very well. Insurance companies take advantage of the fact that most people do not know the laws and their rights. They hope to intimidate you in this way and get money. You should not be afraid and follow their lead. I can advise you to contact lemberglaw.com, they will help you get out of this case. At one time, this company served me very well and helped me win the court. Most people don't even go to court because they know what they're doing is illegal, and they're going to lose the case. Don't ignore their email, just go for a consultation.
